If you have plans of purchasing, leasing, or refinancing a local commercial or industrial property, it’s best to keep in mind that you could be liable for pre-existing environmental conditions on the site, such as hazardous waste, chemical spills, and soil or groundwater contamination.
To protect yourself and to limit your liability, we provide our two-part environmental site assessments, or ESAs, of the property in question. We follow federal, state, and local environmental regulations specific to compliance and due diligence. More importantly, we are experienced in implementing due diligence ESAs and investigating transactions for various property types, including industrial, commercial, and residential.
Our ESAs
Our Phase I environmental site assessments (ESAs) and Phase II ESAs are both critical when establishing the baseline environmental data that commercial and private clients use to make informed business decisions. These are comprehensive site assessments that conclude with a written report detailing our findings and recommendations.
Phase I
Phase I ESA is a detailed study of the property and the surrounding real estate, including a thorough site inspection, occupant interviews, historical records searches, a study of past land uses, spills, tanks, and other environmental conditions. An additional assessment may also be required by a buyer, a seller, or other stakeholders to ensure the property is in good condition.
Phase II
If the Phase I site assessment indicates the possibility of site contamination, a Phase II site investigation may be necessary. This second phase involves invasive observations and sampling, which may include subsurface drilling with soil/groundwater analysis; surface soil and water sampling and analysis; asbestos sampling and testing; waste drum characterization and sampling/testing; and sampling/testing of debris and residue.
