If you plan to purchase, lease, or refinance a commercial or industrial property, you could be liable for pre-existing environmental conditions on the site, such as hazardous waste, chemical spills, and soil or groundwater contamination.
To protect yourself and to limit your liability, Datom Products recommends a Phase I ESA of the property in question. A Phase I ESA is a detailed study of the property and surrounding properties including a thorough site inspection, occupant interviews, historical records searches, and a study of past land uses, spills, tanks, and other environmental conditions. The assessment may also be required by a buyer, seller, or other stakeholder to ensure that the property is in good condition.
When a Phase I site assessment indicates the possibility of site contamination, a Phase II site investigation may be necessary. Phase II investigations involve invasive observations and sampling. These include subsurface drilling with soil/groundwater analysis; surface soil and water sampling and analysis; asbestos sampling & testing; waste drum characterization & sampling/testing; and sampling/testing of debris and residue.
